Should you wish to be a customer or an active user of the www.biogenicpetvitality.eu Webshop (hereinafter referred to as the ”Webshop”), please read the General Terms and Conditions carefully and only use our services if you agree with all its points and consider them binding.

In case of any question related to the operation of the Webshop, the ordering and delivery process, we are at your disposal at the contact details indicated below.

Technical information and detailed conditions related to the use of the Webshop - not included in the present General Terms and Conditions -, are indicated in the additional information available on the interfaces of the Webshop.

Contracts concluded electronically via the Webshop do not qualify as written contracts, they are not registered by the Service Provider operating the Webshop, and therefore they cannot be accessed or viewed retrospectively. The Webshop is not subject to any code of conducts whatsoever.

By using the Webshop, and by placing your order or registering therein, you accept and agree to the provisions of these General Terms and Conditions, acknowledge and accept the provisions thereof.

The products displayed in the Webshop can only be ordered online, with delivery. The images shown on the product data sheets may differ from the actual ones, in some cases the images are displayed as illustrations and - despite all care -, there might be differences in the content of the text, for which we are not responsible.

If - despite of all diligence of the Service Provider -, an incorrect price is indicated on the Webshop, especially the price between "0-49 euros", being obviously incorrect or possibly due to a system error, the Service Provider does not confirm the order, but informs the User about the actual purchase price. The User can place a new order by being informed about the actual purchase price.

This contract is effective from 08 February 2021 until an indefinite period of time.

IV.1. Preliminary information of the General Terms and Conditions

Scope of the GTC

Any matters not regulated by this Regulation are governed by Hungarian law - including the interpretation thereof - in particular Act V of 2013 on the Civil Code (“Civil Code”) and Act CVIII of 2001 on certain issues of electronic commerce services and information society services and the respective provisions of Government Decree No. 45/2014 (II. 26.). on the detailed rules of contracts between consumers and businesses. The mandatory provisions of the relevant legislation shall apply to the parties without any specific stipulation.

This Regulation is effective as of 08 February 2021 and shall remain in force until withdrawal. The Service Provider is entitled to amend the Regulation unilaterally. The Service Provider shall publish the amendments on its website 11 (eleven) days before their entry into force. By using the website, users agree that all regulations related to the use of the website apply to them automatically.

If the user accesses the Webshop operated by the Service Provider or reads its content in any way - even if he / she is not a registered user of the Webshop, he / she acknowledges that the provisions of the Regulation is binding on him / her. If the User does not accept the terms, he / she shall not be entitled to view the content of the Webshop.

This contract is effective from 08 February 2021 until an indefinite period of time.

IV.2. Information on the steps of electronic contracting

Ordering process, entering into a contract, quantity restriction

By purchasing / registering on the website, the user declares that to have read and accepted the terms and conditions of the present GTC.

The data management information on the website will be accepted separately by selecting the consent button provided in the pop-up window before the purchase is finalized, by which you consent to the processing of your personal data related to the purchase and delivery in the manner and for the purpose specified in the data management information.

The user shall provide his / her own (real) data during the purchase / registration. The electronic contract shall be void in case of untrue or personally identifiable data of another person provided during the purchase / registration. The Service Provider excludes its liability if the User uses its services on behalf of another person with the data of another person.

The Service Provider shall not be liable for any delivery delays or other problems or errors that can be traced back to the incorrectly and / or inaccurately provided data by the User.

The Service Provider shall not be liable for any damages resulting from the User forgetting his / her password or becoming available to unauthorized persons for any reason not attributable to the Service Provider.

Range of products and services available for purchase

The displayed products can only be ordered online. The prices shown for the products are indicated in euros, they include the VAT required by law, but they do not include the home delivery fee. There is no extra packing fee.

In the Webshop, the Service Provider indicates the name and description of the product in detail, and displays a photo of the products. The images displayed on the product data sheet may differ from the actual ones and may be used as illustrations. We take no responsibility for any discrepancies due to the image displayed in the Webshop and the actual appearance of the product.

If an incorrect price is indicated on the Website in connection with any product, the Service Provider will not confirm the order placed by the User. The contract is not concluded by submitting the order, but by confirming it by the Service Provider, so in this case, due to the lack of confirmation, no contract is concluded between the parties. The Service Provider informs the User in writing about the incorrect indication of the price and the actual purchase price, who may then decide to continue the order at the real price or cancel the order.

Order process

The user logs in to the Webshop after registering or may start the purchase without registration.

The user shall set the number of product(s) to be purchased.


The user adds the selected products to the cart. Users can view the contents of the cart at any time by clicking on the “cart” icon.

If the User wants to add another product to the cart, selects the "continue shopping" button. If you do not want to buy another product, check the number of products you want to buy. You can delete the contents of the cart by clicking on the "delete - X" icon. To finalize the quantity, click on the “refresh / refresh cart” icon.

The user selects the delivery address and then the delivery / payment method, which is one of the followings:

Payment methods:

Bank card: After placing the order, the User can pay securely via the SimplePay online bank card payment system by entering the card details. Card payment is possible with Visa, Visa Electron, Maestro, MasterCard. SimplePay will send you an email confirmation of a successful payment by card. The amount of the order will be blocked on the current account immediately. After successful payment, the user can return to the Webshop or close the page.

Bank transfer: The user shall transfer the value of the ordered products to the bank account indicated in the confirmation email within 3 days. After crediting the amount to the Service Provider's bank account, the User is entitled to receive the product (s) in the manner specified by him/her.

Paypal: How to make a purchase with Paypal: the details of the transaction are displayed on the left side of the page and two choices are displayed on the right side:

If you have a PayPal registration, you will see the partial details of the pre-specified credit card and the amount to be paid after entering the valid ID and password. If more than one card is registered, you must select the card you want to pay with, then after the selection, the payment will be made by clicking on Pay Now and you will be returned to the store page shortly.

If you do not have a PayPal registration, it is possible to pay the amount with a Guest PayPal access after completing a form without having to register with PayPal.


Our shipping partner is GLS and through their courier service we offer competitive shipping prices hroughout Europe and outside the European Union. Below you can find out about the shipping zones and the shipping prices to your shipping destination. The prices associated with each shipping zone is based on the gross weight of up to 2kgs, which fits 12 units (one dozen) of BiogenicPet Vitality products.

If you do not provide us with the confirmation of the shipping price, your order will be cancelled.


To Zone 1 countries purchase 2 units and the shipping cost is reduced to €5 instead of €8.

We reserve the right to make corrections in case of an error or defect in the products or prices indicated in the Webshop. In such case, we will inform the customer of the new data immediately after recognizing or modifying the error. The buyer is entitled to confirm the order once again or cancel the order, respectively.

The final payable amount includes all costs based on the order summary and confirmation letter. The invoice is included in the package. The user shall inspect the package in front of the courier upon delivery, and in case of any damage to the products or packaging, he/she shall request a report, and in case of a damaged package, he/she is not obliged to accept it. Failure to comply with this obligation does not affect the User's rights of withdrawal and warranties, however, it is necessary to justify why the error was not marked during receipt. The packages will be delivered on working days between 8 am and 5 pm.

After providing the data, the User can send the order by clicking on the “send order” button, but prior to that it is possible to check the entered data once again, and is entitled to send a comment about the order or send us another e-mail request.

The User will receive a confirmation e-mail after the order has been sent. If this confirmation is not received by the User within the expected time limit, depending on the nature of the service - but no later than within 48 hours from the sending of the User's order -, the User is released from the obligation to make an offer or a contractual obligation. The order and its confirmation shall be deemed to have been received by the Service Provider or the User when it becomes available. The Service Provider excludes its responsibility for the confirmation if the confirmation does not arrive on a timely manner because the User has provided an incorrect e-mail address during registration or is unable to receive a message due to the saturation of the storage space belonging to his account.

By clicking on the products or product names, the customer can see the details of the product. By setting the number of items you want to buy and clicking on the shopping cart symbol, the product is placed in a virtual cart. By clicking on the "Cart" button on the top right of the web-shop, the customer will be taken to an overview page and can review at any time which products are in their virtual shopping cart or the content can be changed, if required. If the customer wants to complete the purchase, after entering the payment and delivery details, they can navigate with the “continue” button to get to the payment. Already registered customers can enter their username and password here so that the previously stored information can be used for the order. The shopping can be continued without logging in. In this case, the customer must provide an address or account information. Clicking the "next" button again takes the customer to the second last step of the order, which is "overview". Here, the customer receives an overview of his order, including the prices (including statutory VAT), as well as data and costs for the delivery service. The order is closed by clicking on the "buy" button. This creates a binding offer.

In the Webshop, you can conveniently and easily find the products you want to buy. If you do not know exactly what you want to order, you can easily find the most suitable products using search engines and filtering based on various criteria.

Search by keyword: If you know the name of the product you are looking for, start typing the product name in the search box at the top of the page. We will help you finding by the search engine showing you the products that have the typed keyword in their name. When matching, you can choose from a list that opens in the search engine. It is possible that there are many more hits than the displayed list at one time. In this case, click to see all results. If there are no results, clicking on the magnifying glass icon will not only give you the list by matching the name, but the system will also search in the product description.

On the detailed page of the product, you can read the product description, composition, user manual, information about delivery terms, you can add and turn on the price monitoring service (for possible future purchases - registration is required), mark as favourite and see other people’s experience with the product.

Technical possibilities for detecting and correcting data entry errors

Tools for identifying and correcting data entry errors before sending the order:

The contents of the "Cart" can be checked, changed or even deleted at any time.

Personal data (such as billing address, shipping address, telephone number, etc.) can be checked and changed at any time in connection with the registration in the "My Account" menu.

In the "Cart" menu item, before placing the order, the Customer can review the details of his/her order.

After placing the order, if you have ordered something other than what you wanted by mistake or would like to cancel your order, please indicate it to the e-mail address order@biogenicpetvitality.eu or by phone +36 30/235 6737. It is important to do this as soon as possible after sending the order.

The conclusion of the purchase agreement

A contract concluded on the basis of an order placed online (electronically) in the Webshop is considered a distant contract, which contract does not qualify as a written contract because the Service Provider does not register it and thus, will not be available later. The language of the contract is English.

The electronic receipt of the order by the Service Provider qualifies as the Customer's request (offer). The contract is concluded if the Service Provider sends a confirmation of the fulfilment of the order in an electronic message to the Customer. Both the application and the confirmation shall be deemed to have been received by the other party when it becomes available to it.

The Service Provider shall not be liable for any damages that may result from the fact that the sent confirmation is received incorrectly, illegibly or in the spam folder due to reasons beyond its control - incorrect e-mail address provided by the customer, technical or other error of the mail service provider -, the confirmation is considered to be available to the buyer in this case too.


If the product is not in stock, the Service Provider will notify the Customer via e-mail, and the Customer will either acknowledge or cancel the order. In this case, the contract enters into force on the day when the Service Provider notifies the Customer in an electronic message that the ordered product has been delivered to the courier and the Customer has acknowledged the expected time of performance (does not cancel his order).

Concluding a contract

The description of the product range in the online shop serves illustrative purposes only and does not constitute a mandatory sale offer. The customer makes a binding offer for concluding a contract by completing the ordering process by clicking on the "Submit Order" button. The customer will then receive a written confirmation by e-mail that the order has been received (order confirmation). This order confirmation does not mean that the offer is accepted, it is only an information from the Service Provider that the order (offer) has been received. The contract with the Webshop only enters into force when the Webshop sends a written confirmation (order confirmation) of the ordered product by notifying you by e-mail.

Binding offer, confirmation

The receipt of the order (offer) sent by you will be confirmed by the Webshop within 48 hours, at the latest, by means of an automatic confirmation e-mail, which confirmation e-mail contains the data you provided during the purchase or registration (such as billing and delivery information), the order identifier, the date of the order, the list of products ordered, the quantity, the price of the products, any shipping cost and the final payable amount. Should you notice an error in the confirmation e-mail sent by the Webshop regarding the data in the confirmation e-mail, you must report it within 1 working day to the e-mail address order@biogenicpetvitality.eu or by calling +36 30/235 6737.

You are released from the binding offer and shall not purchase the product if you do not receive a confirmation e-mail from the online store about your order without delay (within 48 hours). The contract with the Service Provider is concluded only when the Webshop sends a written confirmation of the ordered product (order confirmation) by notifying you by e-mail.

The Webshop reserves the right to reject orders that have already been confirmed partly or fully. Partial performance can only take place after having consulted with you.

Prices and delivery fees

All prices include statutory VAT and other price elements, without any parcel delivery costs. There is no minimum order value in the Webshop.


Your ordered products are delivered by our contracted partner, GLS General Logistics System.

The Webshop shall not be liable for any delayed services. GLS delivers during business hours Monday through Friday.

The Webshop will charge the shipping fee based on the information above.

The delivery charges and delivery deadlines indicated in above apply to parcel delivery by courier service.

The courier service will attempt to deliver the package for three times. In case of a first unsuccessful delivery, please contact the GLS Centre at the contact details provided by the courier.

In case of package replacement, please prepare the returned product in its original packaging and prepare it for delivery to the courier.

If all three delivery attempts fail due to the buyer's fault, we will charge an additional cost for a repeated delivery.

Retention of title

Until the full payment of the order goods, such products are the property of the Service Provider. Prior to the transfer of ownership – and without the consent of the Service Provider -, it is not possible to pledge, transfer, process or transform the goods.

IV.3. Prior information concerning the formality, registration and subsequent availability of the contract

This document is not filed, it is concluded only in electronic form, and shall not qualify as a written contract. It is written in Hungarian and it does not refer to a code of conduct. In case of any questions related to the operation of the Webshop, the ordering and delivery process, we are at your disposal at the given contact details.

The scope of these GTC covers the legal relations arising on the basis of purchases on the Service Provider's website (www.biogenicpetvitality.eu) and its subdomains.

IV.4. Prior information on the correction of data entry errors

During placing the order, you have the opportunity to change the data you have entered before finalizing the order (clicking the „back” button in the browser will open the previous page, so you can correct the entered data even if you have already moved to the next page). Please note that it is your responsibility to ensure that the information you provide is entered accurately, as the product will be invoiced or shipped based on the information provided by you. By placing your order, you acknowledge that the Seller is entitled to transfer to you all damages and costs arising from your incorrect data entry and inaccurate data. The Seller excludes its liability for performance based on inaccurate data entry. Please note that an incorrect e-mail address or the saturation of the storage space associated with the mailbox may result in non-delivery of the confirmation and may prevent the conclusion of the contract.

The language of the contract is English.

IV.6. Obligation to provide prior information on the content and performance of the contract

IV.7. Prior information obligation regarding supply and product warranties

Statutory warranty rights apply. The use of veterinary dietary foods requires the prior recommendation and ongoing supervision of a veterinarian. During the period during which such feeds are fed, the veterinarian must be consulted immediately (every six months) for any deterioration in the health of the animal. Biogenicpet.hu Webshop does not take any responsibility for the consequences of improper or medically unapproved use of veterinary dietary foods.

In the event of incorrect performance by the Service Provider, you may assert a warranty claim against

In the case of a consumer contract, you can assert your warranty claims for product defects that already existed at the time of delivery of the product within a limitation period of 2 years from the date of receipt. After the two-year limitation period, you will no longer be able to exercise your warranty rights.

You are entitled to request a repair or replacement - at your choice -, unless it is impossible to meet your demand or a disproportionate additional cost for Tápfutár Webáruház Zrt.

would incur. If you did not request or could not request the repair or replacement, you can request a proportionate delivery of the consideration or the error can be corrected or repaired by someone else at the expense of Tápfutár Webáruház Zrt.

There is no room for withdrawal due to a minor error.

You are entitled to choose another warranty claim compared to the previously chosen one (such as requesting a replacement instead of a repair), but you will be required to bear the cost of such modification, unless it was justified or was due to the Webshop’s cause. You shall notify the Service Provider of the defect immediately after its discovery, but not later than within two months from the discovery of the defect. You can enforce your warranty claim directly against Tápfutár Webáruház Zrt.

. In order to enforce your warranty claim - if you prove that you purchased the product in the online store (by presenting an invoice or a copy of the invoice) within six months of the performance of the contract -, there are no further conditions other than the notification of the error. In such case, the Service Provider will only be released from the warranty obligation if it rebuts this presumption, and therefore proves that the defect of the product occurred after having delivered it to you. If Tápfutár Webáruház Zrt. can prove that the cause of the error arose for a reason attributable to you, the User, you shall not accept your warranty claim. However, after six months from the date of performance, you are obliged to prove that the defect you recognized already existed at the time of performance.

If you assert your warranty claim in respect of the part of the product (with respect to the indicated error) that can be separated from the product, the warranty claim will not be deemed valid for other parts of the product.

Product warranty

The provisions of this section apply only to a natural person acting outside the scope of his or her profession, self-employment or business, who buys, orders, receives, uses, uses goods, and is the recipient (consumer) of commercial communications and offers related to the goods. In the event of a defect in the product (movable property), you, if you are a consumer, may, at your option, assert a specific right or product warranty claim. However, you are not entitled to make a claim for a product warranty and a product warranty for the same defect at the same time, in parallel. However, if the product warranty claim is successfully enforced, you can assert your warranty claim against the manufacturer for the replaced product or repaired part. As a product warranty claim, you may only request the repair or replacement of a defective product. You must prove the defect of the product in the event of a product warranty claim. A product is considered defective if it does not meet the quality requirements in force at the time of placing on the market or if it does not have the characteristics specified by the manufacturer. You can assert your product warranty claim within two years of the product being placed on the market by the manufacturer. Upon expiry of this period, this entitlement is lost. You must notify the manufacturer of the defect without delay after having discovered it. An error reported within two months of the discovery of the error shall be deemed to have been reported without delay. You are responsible for any damage resulting from the delay in notification.

You can exercise your product warranty claim against the manufacturer or distributor of the movable property (Tápfutár Webáruház Zrt.). The manufacturer or distributor (Tápfutár Webáruház Zrt.) is only released from its product warranty obligation if it can prove that:

  • the product was not manufactured or marketed in the course of its business, or

  • the defect was not detectable at the time of placing on the market according to the state of the art or

  • the defect of the product results from the application of legislation or a mandatory official regulation.

The manufacturer or distributor (Tápfutár Webáruház Zrt.) shall prove only one reason for the exemption.

Enforcement of warranty claims

If the product marked as defective does not have a defect and no other defect becomes recognizable during the inspection, the service provider shall not be obliged to fulfill any warranty claims.

IV.8. Prior information obligation on complaint handling and dispute settlement mechanism

Handling costumer complaint

The customer may make a complaint orally or in writing regarding the conduct, activity or omission of the Webshop directly related to the distribution or sale of the goods (services) to consumers.

According to the applicable laws, an oral complaint is immediately investigated by the service provider and - if the nature of the complaint allows, - it remedied as necessary.

If the customer does not agree with the handling of the complaint or it is not possible to investigate the complaint immediately, the service provider shall immediately take minutes of the complaint and its position and provide a copy a) in case of a personal oral complaint to the customer; (b) in the case of an oral complaint by phone, it shall be sent to the purchaser at the latest at the same time as the substantive reply set out in the section on the written complaint and shall follow the provisions on the written complaint. An oral complaint made by phone must be provided with a unique identification number, so that the complaint traceable. This number must be communicated to the customer by the service provider.

The service provider shall examine the written complaint within thirty days upon its receipt and respond to it on the merits, and to take measures to ensure that the response reaches the customer.

If the service provider rejects the complaint, it is obliged to justify its position in its substantive response to the rejection. The service provider is obliged to keep a record of the complaint and a copy of the response for 5 years.

IV.9. Copyrights

The User viewing and using the Website is entitled to use the content of the Website for private purposes only. Private use is free, but it may not even indirectly serve or result in the purpose of generating income.


Within the scope of free use, the use is free of charge, it does not require the permission of the Service Provider, however, even this use may not be aimed at violating the legitimate interests of the Service Provider or for any purpose incompatible with free use. The use of the content of the Website differently results in unauthorized use, against which the Service Provider enforces the legal remedies provided by law against the conduct prohibited by law.


Any business use requires the prior written consent of the Service Provider.


Any documents, images, descriptions and any other content may be downloaded from the Website and its database - even by written consent - solely with express reference to the Service Provider.


The Service Provider reserves all rights to all elements of its service, the Website and its domain names, the secondary domain names formed with them, and the Internet advertising space.


Any adaptation or decryption of the source code of the Website or the use of any application that modifies the Website or any part thereof is prohibited.


Trademarks, logos, designs used by the Service Provider, prescriptions of medicinal products available in the Webshop and all other forms, advertisements, slogans and descriptions of which consumers usually recognize the Service Provider are the sole property of the Service Provider and by purchasing in the Webshop the User shall obtain no right for their use whatsoever.

IV.12. Other information obligation

Data protection

The Service Provider's Webshop takes the protection of its customers' data seriously. This is provided for separately in the Data Protection Regulations, which are part of the GTC.

Unilateral amendment of general terms and conditions

The Service Provider reserves the right to change the price and the General Terms and Conditions. Any changes will take effect from the time they appear in the online store, and the terms and conditions existing at the time of ordering will be accepted with each purchase.

The Webshop is entitled to unilaterally amend these General Terms and Conditions in addition to informing the customers in advance on the Webshop interface. The amended provisions will become effective the first time you use the Webshop after the entry into force, they will apply to orders placed after the amendment.

If you have a problem with a product or service that you have purchased online, you can make a complaint online at https://ec.europa.eu/odr as set out on the website.

Your complaint will be investigated by an independent dispute resolution body in order to help consumers and traders resolve their disputes out of court. The amicable settlement of disputes is usually faster and cheaper than going to court.

IV.13. Right of withdrawal and termination

Right of withdrawal

All consumers have a 14-days’ right of withdrawal under the provisions of Directive No. 2011/83 of the European Parliament and of the Council and Government Decree No. 45/2014 (II.26.) on the detailed rules for contracts between consumers and businesses.

The period open for the exercise of the right of withdrawal expires 14 days from the date on which the User or a third party other than the carrier designated by the User takes over the product.

Any natural person entering into a legal transaction for a purpose which cannot be linked to his entrepreneurial or independent activity shall be considered as a consumer. The following regulations apply to the right of withdrawal and its exercise: In case of further questions related to cancellation, the customer can contact the Biogenicpet.hu Webshop customer service. You have the right to withdraw from this contract without giving any reason within 14 days. The withdrawal period begins on the day on which you or a third party other than the supplier designated by you takes possession of the goods and expires 14 days after that date. If you wish to exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract in a clear statement (sent by post, electronically from the Contact Menu). Legal effects of withdrawal

If you withdraw from this contract, all payments received from you will be refunded immediately, but no later than 14 days after we are notified of your decision to withdraw from this contract, including shipping costs (except for additional costs resulting from deviation from the cheapest standard mode of transport we offer at your discretion). For a refund, we will use the same method of payment as you used in the original transaction, unless you expressly consent to another method of payment; in any case, you will not be charged any fees as a result of this refund. We may withhold a refund until we have received the goods back or you have provided proof that you have returned them: the earlier of the two dates must be taken into account.

The Webshop reserves the right to make any changes or corrections to the Webshop at any time, without prior notice, and to relocate the Webshop to another domain name.

By placing an order, the customer agrees to submit a personal evaluation of the purchased product via a link sent by automatic email.

If in case of violation of the provisions of these regulations by the User the Service Provider does not exercise or does not immediately exercise the rights specified in the Regulations or the relevant legal regulations, or does not act against the User implementing the violation, it does not waive these rights of you can continue to exercise it in full at a later date (no waiver).

If certain provisions of these General Terms and Conditions are declared invalid on the basis of a final court decision, legislation or other act, this shall not affect the other provisions of the GTC, they shall remain in force with unchanged content.
